L’intervention du juge constitutionnel dans l’exercice du pouvoir constituant

Abstract : The Italian Constitutional Court has given itself the power to review constitutional amendments. However, there are few opportunities for it to do so because the exercise of constituent power is very difficult in Italy, where constitutional revisions fail regularly. In December 2016, a constitutional referendum resulted in the failure of the last attempt at constitutional revision, while the reform of the electoral law initiated at the same time was adopted. Since electoral laws have a very close relationship with the constitutional matter, the judicial review carried out on these laws gives to the Italian constitutional judge a power to intervene not only on the legislative power but also on the constituent power.
