Le Comité européen des droits sociaux, gardien de l’Etat social en Europe ?

Abstract : The European Committee of Social Rights, as monitoring body of the European Social Charter, seems dedicated to play the role of guardian of Welfare State in Europe. However, its action is hampered by substantive and procedural constraints that could prevent it from completing the task. Nevertheless, thanks to its case-law, the Committee succeeds to encourage the States and European actors to maintain their respect for social rights in a time of severe economic crisis.
