Formulaires et modèles d'actes : formation pratique et théorique des hommes de loi normands dans la seconde moitié du XVe siècle

Abstract : The training and professional practices of the lawyers in the Northern part of the Kingdom of France has been little studied: we have a few accounts of the careers of notaries and judges that provide us with an indirect glimpse of the type of knowledge required for the drawing up of the many kind of legal documents that were produced in great numbers at the end of the Middle Ages. Twenty years separate two manuscripts from the same region that have been preserved. These texts help to shed light on the nature of the legal and practical knowledge required by the profession. These manuscripts, that we can designate as "legal manuals" contain several types of tea (ordinances of the Exchequer of Normandy, the Normandy Customary, etc.) and most importantly a collection of acts. These acts, most of which have a title, are more or less context-free and can be taken as potential models. A comparative study of texts with the same title allows the structure of these acts to emerge clearly, separating the fixed elements from the variables. Placing these manuscripts in the wider context of the production of legal texts, enables us to investigate the sources the authors used (what documents served as models?) and the intentions of the authors models for whom?). We do not know the identities of these authors but there is little doubt that they were men from the humbler levels of the legal profession, who lived among the ordinary people. Thus, the analysis of these manuals allows us to come closer to the daily lives of the men of the profession and learn about how they were trained and how they worked.
