Abstract

For some years now, European institutions have launched several working groups focused on the development of a harmonized European contract law (PECL, DCFR, Proposal for a 'Regulation on a Common European Sales Law (CESL)… In the field of shipping law, the question arising is the following: are they of any use for operators dealing with shipping law? This paper focuses on one aspect that is interpretation of legal sources or of contracts exploring the potential relevancy of these instruments for shipping law.
